The infernal tower bites the dust

The property that was to be home to a TV tower on Johnson Road was scheduled to be sold at public auction on May 10, but the sudden bankruptcy filing of owner Leslie Agron has put the sale on hold.

Agron defaulted on a deed of trust to the Ernest R. and Audrey M. Turner Foundation by not making payments on the purchase of the property at 1985 Johnson Road next to the dump. He now owes $96,000 in principal, interest and fees. “When Mr. Agron filed for bankruptcy we could not proceed with the foreclosure until we can get a release from the bankruptcy court,” said foreclosure trustee John Ludlow.

Agron filed for bankruptcy under chapter seven of the United Stated Bankruptcy Code on May 9. As opposed to chapter 11 bankruptcy, intended for corporate reorganization so the business can continue, chapter 7 is known as straight bankruptcy under which a business or individual’s assets are liquidated to pay creditors.

Ludlow said the trustee’s sale had been tentatively rescheduled for July 12, pending release from the bankruptcy court He said the minimum bid on the property, assessed at $134,800, would be the $96,000 Agron would need to pay to stop the sale from proceeding.

Agron’s permit to build a television tower at the site, approved for the second time March 18, 2001, gave him three years to get federal communications permits and a building permit for the project. He was given one year to put in place a landscaping and revegetation plan.
