water commissioners have asked proponents of a west side sewer
system to pay for a roundtable discussion with lawyers and
engineers to lay the procedural framework for the sewer proposal
to move ahead.
“What
the board is recommending is that they meet with the district
manager, engineer, our lawyer, their legal counsel and the
bond attorney and discuss the detailed steps necessary for
a successful petition process,” said water commissioner
Renée Coe, following a November 27 special meeting and
conference call with district attorney John Milne.
Coe said
the petition submitted to the district in October did not meet
the legal requirements that would have allowed the district
to proceed with it, from the wording to how those signing for
corporations verified their authority to do so. “The
board found several legal discrepancies which were validated
by our legal counsel,” she said. “We made a motion
to take the petition under advisement and recommend this meeting.
If they’re serious about it we want them to pay for those
professional services.”
