Pot smuggler sentenced to public service

On May 10 Beth Calder-Gellatly pleaded guilty to possessing more than 40 grams of marijuana, a class C felony, in Whatcom County Superior Court.

Calder-Gellatly was arrested at the Point Roberts port of entry on October 4 with Denise Lopez after 32 ounces of marijuana in coolers was found in the truck Calder-Gellatly was driving.

Lopez pleaded guilty to a misdemeanor possession charge in February and was sentenced to pay a $250 fine and serve a one-day sentence, possibly in a jail alternative program.

Calder-Gellatly will pay a $1,000 fine and $800 in court costs, and was sentenced to 20 days in jail, which was converted to 160 hours of community service.

The maximum sentence for the offense is five years in jail and $10,000. Calder-Gellatly’s lower sentence reflects an “offender score” of zero, due to no prior convictions.
